Martial Arts Membership Agreement

This Martial Arts Membership Agreement (“Agreement”) is made effective as of [Date] by and between Evolucao Canada Ltd, located at 333 Spadina Avenue, Back Door Entrance, Toronto, ON M5T2E9 (“Academy”) and [Member’s Name], residing at [Member’s Address] (“Member”).

**1. Membership Services:**

1.1 Evolucao Canada Ltd agrees to provide martial arts instruction and related services to the Member.

1.2 Membership includes access to classes, facilities, equipment, and any other services outlined in Evolucao Canada Ltd’s membership brochure or website.

**2. Membership Term:**

2.1 This Agreement shall commence on [Start Date] and shall continue until terminated by either party in accordance with the terms herein.

2.2 Membership is personal and non-transferable. The Member acknowledges that the membership cannot be transferred to another individual’s name.

**3. Uniform Requirement:**

3.1 The Member agrees to purchase and wear the uniform specified by Evolucao Canada Ltd during all martial arts classes and related activities conducted at Evolucao Canada Ltd.

**4. Pause Membership:**

4.1 Members have the option to pause their membership for up to one month. To pause the membership, the Member must provide written notification to Evolucao Canada Ltd, which must be received before the 15th day of the month preceding the pause. Example: To pause membership for May, notification must be received by April 14th.

4.2 All requests to pause membership must be sent via email to [email protected]. Notifications through other means, (Instagram, in person, or via cellphone) will not be accepted.

4.3 Members are allowed to pause their membership ONCE every six months. Requests to pause more frequently within this period will not be honored.

**5. Termination:**

5.1 Members may terminate their membership by providing written notice to Evolucao Canada Ltd. For the termination to be effective for the current month, the notice must be received via email at [email protected] before the 15th day of that month. Example: To terminate the membership for May, the notice must be received by April 14th. If received on April 15th or later, the termination will take effect at the end of May, and the Member will be responsible for May’s fees.

5.1.1 Notice Requirement: This clause clarifies that the notice must be given before the 15th day of the month for the cancellation to be valid for the current month. Additionally, all late monthly payments must be made for the cancellation notice to be considered valid. Adjustments cannot be made unless formal legal/juridic notice.

5.2 Evolucao Canada Ltd reserves the right to terminate this Agreement immediately for breach of Academy rules or conduct deemed inappropriate by Evolucao Canada Ltd.

**6. Legal Notice for Payment Delay:**

6.1 In case of a payment delay exceeding two months from the due date, Evolucao Canada Ltd reserves the right to provide formal legal notice for immediate payment of outstanding fees. Failure to comply may result in termination of membership and legal action for recovery of dues.

**7. Medical Responsibility:**

7.1 The Member acknowledges and agrees that it is their sole responsibility to ensure they are medically fit to participate in martial arts training.

7.2 The Member understands that martial arts training involves physical activity and assumes all risks associated with such activity, including but not limited to injuries, strains, or other medical conditions.

7.3 The Member agrees to inform Evolucao Canada Ltd of any medical conditions, injuries, or limitations that may affect their participation in classes or use of facilities.

**8. Liability Waiver:**

8.1 The Member acknowledges the risks associated with martial arts training and agrees to release Evolucao Canada Ltd from any liability for injuries sustained during classes or on Evolucao Canada Ltd’s premises.

**9. Code of Conduct:**

9.1 The Member agrees to abide by Evolucao Canada Ltd’s code of conduct, including but not limited to respecting instructors and fellow members, following safety protocols, and maintaining personal hygiene.

**10. Miscellaneous:**

10.1 This Agreement constitutes the entire understanding between the parties and supersedes all prior agreements or understandings, whether written or oral.

10.2 Any modifications to this Agreement must be made in writing and signed by both parties.

**11. Governing Law:**

11.1 This Agreement shall be governed by the laws of Ontario, Canada, without regard to its conflict of law principles.
